CASES DISMISSED! Driver was charged with misdemeanor driving after forfeiture of license due to driving outside of the parameters of a restricted driver’s license (which was ordered by the court after the driver’s license was suspended due to a DUI conviction). The driver missed the first court date for the driving after forfeiture of license charge and the court charged the driver with a second misdemeanor for failing to appear. At trial, the driver’s defense attorney was able to convince the court to DISMISS both charges. The failure to appear charge was dismissed because the defense attorney was able to prove that the driver missed the first court date due to an error with the way the summons was written. The attorney also was able to convince the judge not to convict the driver of the driving after forfeiture of license charge due to mitigating circumstances.
