Driving without a license (1st offense) is a Class 2 misdemeanor which carries the following potential penalties: confinement in jail for up to 6 months, a fine up to $1,000 (see Virginia Code § 18.2-11. Punishment for conviction of misdemeanor (virginia.gov)), and a driver’s license suspension for up to 90 days (see Virginia Code § 46.2-300. Driving without a license (2nd or subsequent offense) is a Class 1 misdemeanor which carries the following potential penalties: confinement in jail for up to twelve months, a fine up to $2,500 (see Virginia Code § 18.2-11. Punishment for conviction of misdemeanor (virginia.gov)), a driver’s license suspension for up to 90 days (see Virginia Code § 46.2-300. Driving without license prohibited; penalties (virginia.gov)), and the vehicle the driver was operating at the time of the offense will be impounded for 3 days or until the driver obtains a valid driver’s license (see Virginia Code § 46.2-301.1.
