Class 1 misdemeanor charge of Reckless Driving for speeding 66 MPH in a 45 MPH zone was DISMISSED with no fine or Court costs imposed by the Court.

Repeat offender was convicted of class 1 misdemeanor Reckless Driving for speeding 84 MPH in a 70 MPH zone.  The conviction resulted in a loss of career and livelihood for the driver, who drove for a living.  Upon review of a law change to the reckless driving statute, in which the threshold for reckless driving was raised from 81 MPH to 86 MPH, the attorney successfully was able to file a Motion to Reopen the case, which was granted.  Upon rehearing of the case, the attorney successfully convinced the Court to REDUCE the charge to Defective Equipment. 

Driver arrested for DUI 1st offense with a heightened BAC (blood test indicated BAC level was .15) and was also charged with Refusal.  Driver walked away from Court with no jail time.  Refusal charge was nolle prossed and DUI 1st conviction was for a normal BAC (not heightened).

Repeat offender charged with Speeding 15-19 MPH above the posted speed limit (85 MPH in a 70 MPH zone) had charge REDUCED to Speeding 1-9MPH over the limit, resulting in less demerit points on driver’s record.

Driver was involved in an accident that was not his fault and caused no injury or damage to other vehicles, but the driver was convicted by the General District Court of class 1 misdemeanor Reckless Driving for driving too fast for road conditions. On appeal to the Circuit Court, the driver’s charge was REDUCED to Defective Equipment.

Traffic ticket for Speeding 20 mph or more above the posted speed (59 MPH / 35 MPH zone) was REDUCED to Defective Equipment, which is a non-moving violation that carries no (0) demerit points toward a driving record.

Driver charged with DWI 1st offense and Refusal walked away from Court with no jail time and was granted a restricted license to drive during the license suspension period imposed by the Court.  The Refusal charge was nolle prossed. 

Traffic ticket for Speeding 15-19 MPH above the limit (44 MPH / 25 MPH zone) was REDUCED to Defective Equipment, which is a non-moving violation that carries no (0) demerit points toward a driving record.

Out-of-state driver and member of the United States Marine Corps charged with class 1 misdemeanor Reckless Driving (Generally) had charge REDUCED to Improper Driving. 

Class 1 misdemeanor Reckless Driving charge for driving at a speed over 85 MPH was REDUCED to a non-criminal traffic infraction of Speeding 1-9 MPH over the limit. 

Repeat offender charged with class 1 misdemeanor Reckless Driving for speeding 69 MPH in a 35 MPH zone walked away from Court with a DISMISSAL.

Repeat offender charged with class 1 misdemeanor Reckless Driving for speeding 81 MPH in a 45 MPH zone was able to walk away without a jail sentence or a license suspension.
